FLEX REWARDS MERCHANT PRIVACY STATEMENT

This Privacy Statement (“Privacy Statement”) explains how Flextech.io Pte. Ltd. (“Flex Rewards,” “us,” “our,” and “we”) handles the information that you provide to us as well as customer information collected when users join your loyalty program, and applies to all businesses or persons who create an account at dashboard.flexrewards.io/signup (“Merchants”) or who otherwise use the Flex Rewards merchant dashboard and services (collectively, the “App/Site”). If you are an app user, your privacy statement terms are in a separate section below.
Summary of Main Terms
1. Flex Rewards takes data privacy seriously. The data collected from our systems is treated as highly sensitive information.
2. As a pre-condition of customers joining a Merchant’s loyalty program on the Flex Rewards app, all our app users (i.e. your customers) will be asked to expressly consent to releasing their names and email addresses to the Merchant. Merchants can view customer names and email addresses on their Flex Rewards dashboard. Merchants are free to copy and retain this data subject to compliance with local data protection laws. By using our service, Merchants agree not to sell or share this information with any third parties. If a Merchant cancels service, we are not obligated to continue making this data available to the Merchant.
3. Depending on which country you are from, customers may have the right to request deletion of their personal information. If Flex Rewards is requested to remove a user’s personal information, we will comply. Merchants must also comply with any request to remove customer information from their records.
4. While we strive to maintain the strictest data security measures, there is always a possibility that our systems could be subject to malicious attack or hacks. In the event of a data breach, we will take all measures to mitigate any harm to our app users and to our Merchants. However, you agree not to hold us responsible for events like this that are not under our control.
1. Data Ownership
All data collected from the Flex Rewards app remains the sole and exclusive property of Flex Rewards. As part of our service to you, we display the names and email addresses of each user that joins your loyalty program (“Customer Data”) on your Flex Rewards Dashboard. You may view, copy and download this Customer Data during the term of service with Flex Rewards. However, you may not directly or indirectly sell, share, transfer, license, or assign Customer Data to any third parties. Customer Data is provided to you under a non-exclusive revocable license with Flex Rewards. If your service is terminated with Flex Rewards for any reason, your license to use the Customer Data shall automatically cease.
2. Customer Consent
Customers who join your loyalty program will be asked to expressly consent to releasing their names and email addresses to you for email marketing purposes. If customers do not consent to such release of their contact information, they will be unable to join your loyalty program.
3. How We Use Merchant and Customer Data
We may use Merchant and Customer Data for, among other things, statistical and analytical purposes to improve the user experience, to make improvements to the way we deliver our service to Merchants and Customers, for design and product improvements, and for understanding and engaging our target audience for better marketing purposes. We may also share or exchange Merchant and Customer Data with technical partners to provide value-added services, new features, additional products, or other enhancements to the Merchant or Customer experience with Flex Rewards.
4. Images & Logos Uploaded to the Dashboard
You agree that we have the right to use images, logos or other information that you upload to your Dashboard in the App so that we can display your program details on the Flex Rewards app to our users. It is your responsibility to ensure that you have the proper licenses and legal permissions to use such images or logos.
5. Financial Data
We do not retain your credit card information. Financial information is processed through Stripe.
Flex Rewards has implemented administrative, technical, and physical security controls that are designed to safeguard your information. However, no online activity is ever fully secure or error-free. While we strive to protect your information, we cannot guarantee that your information is absolutely secure. Please keep this in mind when disclosing any information to Flex Rewards.
Please recognize that protecting your information is also your responsibility. We urge you to take every precaution to protect your information when you are on the Internet, or when you communicate with us and with others through the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account might have been compromised), or if you suspect someone else is using your account, please let us know immediately by contacting us as indicated in the Contact Us section below.
In the event of a security breach you hereby agree to indemnify Flex Rewards, its directors, employees, affiliates and subsidiaries, and hold us harmless from any direct, indirect or consequential loss, cost or damage that you may incur as a result of such breach.
7. Data Retention
We will retain your account information for as long as your account is active or as needed to provide you services and to maintain a record of your transactions for financial reporting purposes. We will also retain and use your account information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may retain aggregate or anonymized data indefinitely.
8. Third-Party Sites
Some of the functionality may be provided by third parties. For example, we use services like Stripe for payment processing. These third parties are not under our control and Flex Rewards is not responsible for their privacy policies or practices. If you provide any personal information to any third party or through any such third-party website, we recommend that you familiarize yourself with the privacy policies and practices of that third party.
9. Directory Listing and Social Media Usage
We may, from time to time, for marketing purposes disclose to the public that your business is on the Flex Rewards platform. We may do so by promoting your business on the Flex Rewards website, informing our audience that you have joined Flex Rewards on our social media channels like Facebook, Instagram, Twitter, Telegram and TikTok. You agree that we may use your logo, business name, store address, website link, and your business images etc. for such marketing purposes. You may request that we take down or modify any such images by sending a request to [email protected]
10. Children’s Information
The Flex Rewards services are not intended for children under 18 years of age and we do not knowingly collect information from children under the age of 13 through Flex Rewards. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personally identifiable information to us, please contact us at [email protected]. A parent or guardian of a child under age 13 may review and request deletion of the child’s personal information.
11. Accessing and Correcting Your Personal information, and Your Choices
Keeping your personal information current helps ensure that we provide you with the most relevant services. You can access and update your personal information via your account profile. While we are ready to assist you in managing your registrations, deactivating your account, and removing your active profile and data, we cannot always delete records of past interactions and transactions. For example, we are required to retain records relating to payments issued to you for financial reporting and compliance reasons. In addition, because of the way we maintain certain services, after you delete certain information, we may temporarily retain backup copies of such information before it is permanently deleted.
If we send you marketing emails about services that may interest you, each email will contain instructions permitting you to “opt-out” of receiving future marketing or other communications.

12. Your California Privacy Rights
Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for their direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. To request a copy of the information disclosure provided by DoorDash pursuant to Section 1798.83 of the California Civil Code, please contact us via the email or mailing address provided below. Please allow 30 days for a response.
13. California Do Not Track Disclosure
Flex Rewards does not have a mechanism in place for responding to browser “do not track” signals or other similar mechanisms used to limit collection of information for use in Online Behavioral Advertising.
14. International Users
Flex Rewards runs its services on Google Cloud Platform, regardless of where you use the Flex Rewards services, the information collected as part of that use will be transferred to and maintained on servers located in the United States. Any information we obtain about you will be stored in accordance with U.S. privacy laws, regulations, and standards, which may not be equivalent to the laws in your country of residence. By using Flex Rewards, you consent to this collection, transfer, storage, and processing of information to and in the United States.

16. Governing Law and Dispute Resolution
Any disputes arising from or in connection with this agreement shall be resolved by binding arbitration in Singapore before the Singapore International Arbitration Commission. This agreement is governed by Singapore law. The language of arbitration shall be English.

This Privacy Statement (“Privacy Statement”) explains how Flextech.io Pte. Ltd. (“Flex Rewards,” “us,” “our,” and “we”) uses your information and applies to all who use our Flex Rewards app, our website www.flexrewards.io, mobile applications, touch technologies, electronic services, social networking sites, interactive features, online services – or any of our described online activities we own or control, including any online activities owned, controlled, or operated by Flex Rewards Affiliates, (collectively, the “App/Site”).
By using the App/Site, you agree to the terms of this Privacy Statement. If you do not agree with the practices described in this Privacy Statement, please do not provide us with your personal information or interact with the App/Site.
We may modify this Privacy Statement at any time. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by means of notice on the App/Site prior to the change becoming effective. 1. Types of Information We Collect
We will collect information, including Personal Information and Non-Identifying Information, when you interact with us and the App/Site, for example when you:
• access or use the App/Site;
• register, subscribe, or create an account with Flex Rewards;
• open or respond to our e-mails;
• refer friends, family, or others to Flex Rewards;
• contact customer service or use other customer support tools;
• provide information to enroll or participate in Other Programs provided on behalf of, or together with, Business Partners;
• visit any page online that displays our ads or content;
• purchase products or services on or through the Site;
• connect or link to any Site via social networking sites;
• post comments to Online Communities; and
• provide information to our Vendors.
This Privacy Statement does not apply to the collection of information in any way other than as listed above.
2. Your Choices
We think that you benefit from a more personalized experience when we know more about you and what you like. However, you can limit the information you provide to Flex Rewards, and you can limit the communications that Flex Rewards sends to you.
(a) Commercial E-mails
You may choose not to receive commercial e-mails from us by following the instructions contained in any of the commercial e-mails we send or by logging into your account and adjusting your e-mail preferences. Please note that even if you unsubscribe from commercial email messages, we may still e-mail you non-commercial e-mails related to your account and your transactions on the Site. You may update your subscription preferences at any time.
(b) Cookies and Other Technologies
You may manage how your browser handles Cookies by adjusting its privacy and security settings. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available. You can opt-out of being targeted by certain Third-Party Ad-Servers and Flex Rewards-served ads online using the National Advertising Initiative’s Opt-Out Tool or the Digital Advertising Alliance’s (DAA) About Ads Opt-Out Tool. Currently, we do not alter our data collection and use practices in response to Do Not Track signals.
We use Non-Identifiable Information and Device Data to directly serve you interest-based ads on third party websites and mobile applications. Interest-based ads served directly by Flex Rewards on third party sites will display the AdChoices icon. If you prefer not to receive interest-based ads from Flex Rewards on third party sites, you can click on the AdChoices icon in the ad, which will direct you to the Your Flex Rewards AdChoices page where you can opt-out of receiving interest-based ads served by Flex Rewards.
(c) Device Data
You may manage how your mobile device and mobile browser share certain Device Data with Flex Rewards, as well as how your mobile browser handles Cookies by adjusting the privacy and security settings on your mobile device. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.
When you first visit or use the App/Site we will request permission to collect and use your device’s precise geolocation. You can opt not to permit the collection of this information, or permit it only when using the mobile app, but it may limit certain functions or features of the App/Site. You can control how and whether we collect your precise geolocation information through your device’s settings.
(d) E-mails from Business Partners
If you wish to opt out of receiving offers directly from our Business Partners, you can follow the opt-out instructions in the emails that they send you.
3. How Flex Rewards Uses Information
We (or our Vendors on our behalf), use information collected as described in this Privacy Statement to:
• Operate, maintain and improve the Site and our services, and Other Programs;
• Provide you with interest-based ads, push notifications, communications, and offers for products and services from us and participating Business Partners, including based on your precise geolocation;
• Facilitate and fulfill orders placed on the App/Site and Other Programs – for example, for Flex Rewards vouchers and other goods and services, including tracking redemption;
• Evaluate your eligibility for certain types of offers, products or services that may be of interest to you, and analyze advertising effectiveness;
• Answer your questions and respond to your requests;
• Perform analytics and conduct customer research;
• Communicate and provide additional information that may be of interest to you about Flex Rewards and our Business Partners, sometimes by combining your information with information from Other Sources;
• Send you reminders, technical notices, updates, security alerts, support and administrative messages, service bulletins, marketing messages, and requested information, including on behalf of Business Partners;
• Administer rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored by us or our Business Partners;
• Allow you to apply for a job, post a video or sign up for special offers from merchants, Business Partners, or third parties through the App/Site and Other Programs;
• Enhance other information we have about you directly or from Other Sources to help us better understand you and determine your interests, and to
• Use your data as described in our Card Linked Deals program, if you consented to participate in such program.
We also may use information collected as described in this Privacy Statement with your consent or as otherwise required or permitted by law.
Flex Rewards uses your geolocation, including your precise geolocation, consistent with this Privacy Statement as described in Section 5 below to deliver location-based offers, products or services that may be of interest to you.
If you use any features on the App/Site to send information about a product or service to another person (e.g., a friend, a colleague, a professional associate, etc.), we will also collect the Personal Information of that other person to the extent disclosed by you and may contact them using the information you provided us.
4. When and Why Flex Rewards Discloses Information
We (or our Vendors on our behalf) may share your Personal Information as required or permitted by law:
• with any Flex Rewards Affiliate who may only use the Personal Information for the purposes described in this Privacy Statement;
• with our Vendors to provide services for us and who are required to protect the Personal Information;
• to report or collect on debts owed to us or our Business Partners;
• with relevant Business Partners:
• with whom we jointly offer products and services;
• with whom we have entered into an agreement that provides for the disclosure, sale, lease, or license of your Information;
• to facilitate a direct relationship with you, including in connection with any program we administer on behalf of the Business Partner;
• to enable electronic communications with you as part of purchase, a sponsored reward, offer, contest, program, or other activity in which you have elected to participate;
• to the extent you have purchased or redeemed a Flex Rewards voucher, goods or services offered by a Business Partner or participated in an offer, rewards, contest or other activity or Other Programs sponsored or offered through Flex Rewards on behalf of that Business Partner;
• with a purchaser or prospective purchaser of Flex Rewards or any of the Flex Rewards Affiliates (or all or a portion of their assets), as described below in Section 10;
• to comply with legal orders and government requests, or as needed to support auditing, compliance, and corporate governance functions;
• to combat fraud or criminal activity, and to protect our rights or those of our Affiliates, users, and Business Partners, or as part of legal proceedings affecting Flex Rewards;
• in response to a subpoena, or similar legal process, including to law enforcement agencies, regulators, and courts in the United States and other countries where we operate; or
• with your consent.
We encourage Business Partners to adopt and post privacy policies. However, their use of Personal Information obtained through Flex Rewards is governed by their privacy policies and is not subject to our control.
We may also disclose Non-Identifiable Information:
• for the same reasons we might share Personal Information;
• with Business Partners for their own analysis and research;
• to facilitate targeted content and ads; or
• with Third-Party Ad-Servers to place our ads and/or ads of our merchants or Business Partners on the Site and on third-party sites, and to analyze the effectiveness of those ads.
5. How Flex Rewards Collects Information
You provide us with your Personal Information when you register, subscribe, create an account, make a purchase, or otherwise when you provide us with your Personal Information during your interaction with the App/Site and Other Programs. We also collect Personal Information when you contact us online for customer service and other support using self-help tools, such as email, text, or by posting to an Online Community.
Device Data may be collected automatically, and as soon as your device interacts with the App/Site and Flex Rewards, even if you are not logged into the App/Site using your device. If you have questions about the security and privacy settings of your mobile device, please refer to instructions from your mobile service provider or the manufacturer of your device to learn how to adjust your settings.
We collect your location information, including precise real-time geolocation, such as through look up based on IP address, GPS, Bluetooth, or WiFi signals, consistent with your choice of mobile device settings. We may also collect the precise location of your device when the app is running in the foreground, background, or even if you are not directly using the application depending on your device and its settings. Your device, as well as the Flex Rewards mobile app, provides you with options to control how and when we collect your geolocation. You may be able to disallow our use of certain location data through your device or browser settings, for example, by disabling “Location” services for the Flex Rewards application in iOS privacy settings.
6. Security of Personal Information
Flex Rewards has implemented an information security program that contains administrative, technical and physical controls that are designed to reasonably safeguard Personal Information. For example, we use industry-standard encryption technology to secure Financial Account Information. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. 7. Accessing and Correcting Personal Information
You can access, update and delete your Personal Information you provided to us, as described below, by managing this information through your online account or sending us an email at [email protected]. You can update or remove Financial Account Information as well. Keeping your Personal Information current helps ensure that we, our Affiliates and Business Partners offer you the offers that are most relevant to you.
If you want to deactivate your Flex Rewards account or have other questions or requests, please contact us. While we are ready to assist you in managing your subscriptions, deactivating your account, and removing your active profile, we cannot always delete records of past interactions and transactions. For example, we are required to retain records relating to previous purchases on the App/Site for financial reporting and compliance reasons.
We will retain your Personal Information for as long as your account is active or as needed to provide you services and to maintain a record of your transactions for financial reporting purposes. If you wish to deactivate your account or request that we no longer use your Personal Information to provide you services contact us at [email protected]. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
8. Social Networks
Social Community Areas
You also have the option to link social networks, such as Facebook, to your Flex Rewards account. Once you register with Flex Rewards and connect with the social network, you will be able to automatically post recent Flex Rewards activity back to your social network.
9. Privacy Practices of Third Parties
This Privacy Statement only addresses the use and disclosure of information by Flex Rewards through your interaction with the App/Site. Other websites that may be accessible through links from the App/Site and Other Programs may have their own privacy statements and personal information collection, use, and disclosure practices. Our Business Partners may also have their own privacy statements. We encourage you to familiarize yourself with the privacy statements provided by these other parties prior to providing them with information or taking advantage of a sponsored offer or promotion.
10. Business Transfers and Corporate Changes
Flex Rewards and our Affiliates reserve the right to disclose, transfer, or license any and all information related to the App/Site, including Personal Information:
• to a subsequent owner, co-owner or operator of one or more of the App/Sites or any portion or operation related to part of one or more of the App/Sites; or
• in connection with a corporate merger, consolidation, or restructuring, the sale of substantially all of our stock and/or assets, or other corporate change, including, without limitation, during the course of any due diligence process.
11. Notice to Residents of Countries outside the United States of America
If you live outside the United States (including in the European Economic Area (“EE”) and Switzerland (“CH”) collectively the “EEA/CH”), and you use the App/Site or provide us with Personal Information directly via the App/Site, your information will be handled in accordance with this Privacy Statement. By using the App/Site or giving us your Personal Information, you are directly transferring your Personal Information and Non-Identifiable Information to us in the United States. You agree and consent to our collection, transfer, and processing of your Personal Information and Non-Identifiable Information in accordance with this Privacy Statement. You are solely responsible for compliance with any data protection or privacy obligations in your jurisdiction when you use the App/Site or provide us with Personal Information. Regardless of where we transfer your information, we still protect your information in the manner described in this Privacy Statement.
12. Children’s Privacy
The App/Site is a general audience site not directed at children under the age of 12.
By using Flex Rewards, you represent that you are at least eighteen years old and understand that you must be at least eighteen years old in order to create an account and purchase the goods or services advertised through the App/Site. We will promptly delete information associated with any account we obtain actual knowledge is associated with a registered user who is not at least eighteen years old.

Flex Rewards utilizes various valid data transfer mechanisms for Personal Information at its sole discretion in accordance with applicable data protection and privacy laws. We will continue to monitor and assess the appropriateness of other valid data transfer mechanisms as they become available.

Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
14. Glossary of Terms
Affiliate means an entity owned, directly or indirectly, by Flextech.io Pte. Ltd. or that is controlled by or under common control with Flextech.io Pte. Ltd. and also includes joint ventures entered into by Flextech.io Pte. Ltd. and/or its Affiliates. References in this Privacy Statement to “Flex Rewards,” “we,” or “us” also apply to Affiliates.
Business Partners means, collectively, third parties with whom we conduct business, such as merchants, co-marketers, distributors, resellers, and other companies or organizations with whom Flex Rewards enters into agreements to support its business and operations.
Cookie means a unique identifier, usually made up of small bits of text or code. For more information, please read our Cookies Policy.
Device Data means information concerning a device you use to access, use, or interact with the App/Site, such as operating system type or mobile device model, browser type, domain, and other system settings, the language your system uses and the country and time zone of your device, geolocation, including precise geolocation, unique device identifier or other device identifier, advertising identifier, mobile phone carrier identification, and device software platform and firmware information.
Non-Identifiable Information means information that alone cannot identify you, including data from Cookies, Pixel Tags and Web Beacons, and Device Data. Non-Identifiable Information may be derived from Personal Information.
Online Communities means, collectively, our social networking pages or accounts, forums, bulletin boards, discussion groups, chat rooms or other methods of communication that may be offered on or linked through the App/Site.
Other Programs means special programs, features and functionality on our App/Site or other co-branded websites with Business Partners that we reasonably control and that have special use terms applicable to such special programs, features and functionality.
Other Sources means sources of information that legally provide Flex Rewards with your information, and which are outside the scope of this Privacy Statement at the time of collection.
Personal Information means information about you that specifically identifies you or, when combined with other information we have, can be used to identify you. This includes the following types of information:
• Contact Information: your name, postal addresses, email addresses, social networking website user account names, telephone numbers, or other addresses at which you are able to receive communications.
• Relationship Information: information you provide that enables us to determine lifestyle, interests, and activities, including location information related to your state/province, city, or neighborhood; areas of interest, the types of deals that interest you, information collected through your interactions with social networks, demographic information (e.g., birth date, age, gender); information about persons for whom you have purchased Flex Rewards vouchers as gifts or who have bought Flex Rewards vouchers as gifts for you; and information about friends who refer you or whom you have referred;
• Transaction Information: information you provide when you interact with us and the Site, such as the Flex Rewards vouchers you are interested in, purchase and redeem; email and other communications; and how you interact with Business Partners and our Vendors; and
• Financial Information: information collected from you as needed to process payments for Flex Rewards vouchers or other products or services that you buy, or as provided by you to administer your participation in optional services and programs, such as your payment card number, expiration date, and card verification number.
Pixel Tags and Web Beacons mean tiny graphic images placed on website pages or in our emails that allow us to determine whether you have performed specific actions.
Third-Party Ad-Servers means Vendors and other third parties that provide the technology to place ads on websites and track ad performance.
Vendors means, collectively, third parties that perform business operations on behalf of Flex Rewards, such as transaction processing, billing, mailing, communications services (e-mail, direct mail, etc.), marketing, data processing and analytics, servicing, collections, ad management, or information technology services.
